The Malaysian Cabinet has approved government-use licences to bring in generics of Sofosbuvir – Hepatitis C treatment – amidst Gilead’s current licensing deal. This is in line with the efforts to present more affordable treatment options in the country.

I wish to provide clarity for the author and readers the distinction between compulsory licensing (Section 48) and Rights of Government (Section 84) as the two cannot be used interchangeability under the Malaysian Patent Acts 1983 although the outcome is the same - exploitation of patent. The difference is in the procedures in obtaining Compulsory Licensing is clearly spelt out (Section 49) which is required for MOH to follow (if they had chosen this route) and any breach in the proc...
